Terms of Service

These Terms of Service govern your use of getysotope.com and the YSOTOPE clinical dosimetry platform (together, the "Service") operated by YSOTOPE Theranostics S.L. ("the Company"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.

If you are a consumer (a natural person acting wholly outside your trade, business, craft, or profession), nothing in these Terms limits or excludes the statutory consumer rights to which you are entitled under the laws of your country of residence within the European Economic Area.

1. Who We Are and What This Service Is

YSOTOPE Theranostics S.L. (Avinguda Diagonal 640, Planta 6, 08028 Barcelona, Spain) is a clinical decision-support software company providing AI-assisted radiopharmaceutical dosimetry tools for oncology centres engaged in targeted radionuclide therapy. The Service comprises this informational website and, for credentialled clinical partners, a secure platform for uploading molecular imaging data and receiving patient-specific absorbed-dose calculations.

The clinical dosimetry platform is a decision-support tool intended for use by qualified nuclear medicine physicians and medical physicists. Reports generated by the platform are intended to inform clinical judgement and do not substitute for it. Prescribing decisions remain the sole responsibility of the treating clinician.

2. Agreement

These Terms govern your use of the Service operated by YSOTOPE Theranostics S.L. (Avinguda Diagonal 640, Planta 6, 08028 Barcelona, Spain). By using the Service you accept these Terms. If you do not accept them, do not use the Service.

If you are a consumer (a natural person acting outside your trade, business, craft, or profession), nothing in these Terms limits your statutory consumer rights under your country of residence.

3. Use of the Service

  • You must be at least 18 years old or have parental consent to use this website.
  • Clinical platform access is restricted to credentialled users (nuclear medicine physicians, medical physicists, and authorised clinical staff) at partner institutions that have signed a separate service agreement with the Company.
  • You agree not to use the Service for unlawful purposes, to interfere with its operation, or to attempt unauthorised access to any part of the platform.
  • You may not copy, scrape, or reverse-engineer the Service except as permitted by mandatory law.
  • Clinical data uploaded to the platform must only be data you are authorised to process under applicable data-protection law, your institution's data governance policies, and any applicable ethics approvals.

4. Intellectual Property

The Service, including all content, software, algorithms, dose-calculation methodologies, and documentation, is owned by the Company or its licensors and is protected by EU and international intellectual property law. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended clinical or informational purpose. Nothing in these Terms transfers ownership of any intellectual property to you.

De-identified, aggregated statistical outputs derived from platform usage may be used by the Company for scientific research and product improvement, subject to applicable law and the terms of your institution's service agreement.

5. User Content and Clinical Data

You are responsible for any content and data you submit to the Service. By submitting clinical imaging data, you represent that you have the necessary authorisations (including patient consent or a lawful processing basis under GDPR) to share those data with the Company for the purpose of generating a dose calculation. You grant the Company a limited licence to use, store, and process the submitted data to provide the requested Service.

The Company processes clinical imaging data as a data processor acting on your institution's instructions. The full terms of that processing relationship are set out in the data-processing agreement between the Company and your institution.

6. Right of Withdrawal (Consumer Contracts)

Where you enter into a paid contract with the Company as a consumer at a distance, you have the right to withdraw within 14 days under the EU Consumer Rights Directive without giving any reason. To exercise this right, contact us at [email protected] with a clear statement of withdrawal. We will refund all payments received within 14 days of receiving your withdrawal notice.

The Service as currently offered through getysotope.com does not include direct paid digital content accessible to consumers; this clause applies only if and when paid services are offered to consumers directly.

7. Disclaimers and Statutory Guarantees

The Service is provided on an "as is" basis to the extent permitted by law. Nothing in these Terms excludes or limits the Company's liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under mandatory law. Statutory guarantees applicable to consumers under EU law are not affected by these Terms.

The clinical dosimetry platform generates dose recommendations based on the imaging data submitted and established pharmacokinetic modelling approaches. These recommendations are decision-support outputs. They are not a substitute for independent clinical assessment by qualified medical professionals and should not be acted upon without such assessment.

8. Limitation of Liability

To the extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed EUR 100, except for liability that cannot be limited under mandatory law (see Section 7 above). This cap does not apply to the clinical platform service relationship governed by the separate institutional service agreement, under which different liability terms may apply.

9. Termination

We may suspend or terminate your access to the Service for material breach of these Terms or for conduct that we reasonably believe poses a risk to the Service, other users, or the Company. Provisions that by their nature should survive termination will do so, including Sections 4, 7, 8, 10, and 11.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain.

The courts of Barcelona, Spain have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service, subject to the mandatory consumer-protection rules of your country of residence within the EU (Article 17-19 of Regulation (EU) 1215/2012). If you are a consumer habitually resident in an EU member state, you may also bring proceedings before the courts of your habitual residence, and the Company may bring proceedings against you only in those courts.

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. The Company does not commit to using ADR procedures but will cooperate with any competent ADR body where required by applicable law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be published with a new "Last updated" date. For institutional platform users, material changes affecting service terms will be communicated directly to the designated contact at your institution.
